Today, October 28, 2024, the Hangzhou Intermediate People's Court is hearing two cases of patent infringement disputes between Huawei and MediaTek, with case numbers (2024) 浙01知民初102号 and (2024) 浙01知民初103号. Huawei is the plaintiff and the defendant is MediaTek. Huawei accuses MediaTek of infringing two LTE/4G patents.
“Huawei v MediaTek” hearing information
The CNIPA has disclosed two Huawei patents suspected of being involved in the case.
The first patent, CN102281641, which was previously used in a lawsuit between Huawei and Samsung, filed in 2007 and titled "Method and device for identifying user equipment and method for transmitting and allocating temporary identity". The first oral hearing of Huawei's invalid challenge procedure for this patent in the CNIPA on October 25, 2024. The second oral hearing will be held on November 11, 2024.
The second patent, CN104685923B，"Method and device for allocating bandwidth, user equipment and base station".According to the records of the CNIPA, HMD once challenged this patent in 2023, but failed.
On July 18, 2024, PRIP reported that Huawei had filed a patent lawsuit against MediaTek in China. MediaTek announced on July 19th that it has confirmed the lawsuit with Huawei. Subsequently, IAM journalist Olivia Rafferty reported that MediaTek had filed a counteroffensive against Huawei in the UK Court on July 15, 2024.
In fact, MediaTek not only counter-sued Huawei in the UK, but also filed patent infringement lawsuits against Huawei in China.
In the same local court, MediaTek also sued Huawei in the Hangzhou Intermediate People's Court. However, based on the case number, (2024) 浙01知民初89号 and (2024) 浙01知民初90号, MediaTek's counterclaim against Huawei may have been filed earlier than Huawei's lawsuit against MediaTek in the Hangzhou Intermediate People's Court. The first hearing was held on October 17, 2024.
This may mean that Huawei's first lawsuit against MediaTek in China may be in another local court. But we don't know which court it is now. This may mean that Huawei and MediaTek's lawsuit in China is being pursued simultaneously in multiple local courts.
